("Potluck," "we," "us," or "our") have created this privacy policy (this "Privacy Policy") because we know that you care about how information you provide to us is used and shared. This Privacy Policy relates to the information collection and use practices of Potluck in connection with our Website. By visiting or using our Website, Visitors and Registered Users are agreeing to the terms of this Privacy Policy and the accompanying Terms of Use. Capitalized terms not defined in this Privacy Policy shall have the meaning set forth in our Terms of Use.
This Privacy Policy explains how we collect, use, disclose, and protect personal information when you use the Website.
By using the Website, you consent to the collection and use of information in accordance with this Privacy Policy.
The Information We Collect and/or Receive
1. Personal Information
In the course of operating the Website and/or interacting with you, Potluck will collect (and/or receive) the following types of information. You authorize us to collect and/or receive such information.
When you sign up to become a Registered User, you will be required to provide us with personal information about yourself, such as your name, e-mail address, and other contact information. If you contact us or RSVP to an Event, you will need to provide your name and e-mail address. Registered Users may also provide identifiable information in the course of using the Website. All information we collect and/or receive under this section is collectively called "Personal Information." We do not collect any personal information from Visitors or Registered Users unless they provide such information voluntarily.
2. Other Information
In addition to the Personal Information, we may automatically collect or receive additional information regarding you and your use of our Website as well as information regarding your computer or other devices used to access our Website (collectively, the "Other Information"). Such Other Information may include:
a. From Your Activity
• IP address, which may consist of a static or dynamic IP address and will sometimes point to a specific identifiable computer or device;
• Browser type and language;
• Referring and exit pages and URLs;
• Date and time;
• Details regarding your activity on the Website, such as search queries, amount of time spent viewing pages, and other performance and usage data.
b. About Your Device
• Type of device;
• Advertising Identifier ("IDFA" or "AdID");
• Operating system and version (e.g., iOS, Mac OS X or Windows 10);
• Carrier; and
• Network type (WiFi, 3G, 4G, LTE).
c. From Cookies
We may use both session cookies, which expire once you close your web browser, and persistent cookies, which stay on your computer until you delete them and other technologies to help us collect data and to enhance your experience with the Website. Cookies are small text files a website can use to recognize a repeat visitor to the website. We may use cookies for various purposes, including to:
• authenticate users;
• personalize your experience;
• analyze which portions of the Website are visited or used most frequently.
If you do not want Potluck to deploy cookies in your browser, you can opt out by setting your browser to reject cookies or to notify you when a website tries to put a cookie in your browser software. d. Third-Party Analytics
We use Google Analytics, a web analytics service provided by Google LLC ("Google"), to help us understand how visitors use our Website. Google Analytics collects information such as how often users visit the Website, what pages they visit, and what other sites they used prior to arriving on our Website. Google Analytics uses cookies and similar technologies to collect this information. The information generated by these cookies about your use of the Website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the Website, compiling reports on Website activity for us, and providing other services relating to Website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google. You may refuse the use of cookies by selecting the appropriate settings in your browser. e. From You
We may also collect additional information that you voluntarily provide to us (either directly or via our social media pages), such as your age, gender, preferences, or other information that does not identify you personally.
We use analytics and tracking tools including:
• PostHog Analytics (which may include session replay technology)
• Meta Pixel
• Google Ads measurement tools
Session replay technology may record user interactions such as clicks, scrolls, and navigation behavior to help us analyze how the Website is used.
Cookies
We use cookies and similar technologies to maintain sessions, remember preferences, analyze usage, and support marketing communications. Users can manage cookies through the Website cookie banner and settings.
Our Commitment: No Advertising and No Sale of User Data
Potluck does not sell advertising within our platform. We will never sell or share your Personal Information or Other Information with any third-party company for advertising, marketing, or commercial purposes without your prior written and express permission. We do not work with third-party advertising networks, behavioral targeting companies, or ad optimization services, and we do not permit third parties to collect information about you through our Website for advertising purposes.

How the Information is Used and Shared
We may also use and/or share Information as described below.
Accessing and Modifying Information and Communication Preferences
• Potluck will access, use, and share the Information as required to provide services or support to you in connection with your use of the Website.
• We will not sell or share your Information with any third-party company without your prior written and express permission. Any such sharing that you authorize will be limited to the specific purpose and party you have approved.
• With your permission, third-party applications or services may access your Personal Information. We use standard OAuth (open authorization) to enable you to give permission to share your Personal Information with other websites and services, such as LinkedIn, Facebook and Twitter (e.g., when you agree to a pop-up requesting you to allow another application to access your account information). We also use OAuth to allow us to share information about you that is stored by us without sharing your security credentials.
• We may employ other companies and individuals to perform functions on our behalf. Examples may include providing technical assistance, order fulfillment, customer service, and marketing assistance. These other companies will have access to the Information only as necessary to perform their functions and to the extent permitted by law.
• In an ongoing effort to better understand our users, and our products and services, we may analyze Information in aggregate form in order to operate, maintain, manage, and improve the Website and/or our products and services. This aggregate information does not identify you personally. We may share this aggregate data with our affiliates, agents, and business partners. We may also disclose aggregated user statistics in order to describe our products and services to current and prospective business partners and to other third parties for other lawful purposes.
• We may share some or all of your Information with any of our parent companies, subsidiaries, joint ventures, or other companies under common control with us.
• As we develop our businesses, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, sale of assets, dissolution, or similar event, the Information may be part of the transferred assets.
To the extent permitted by law, we may also disclose the Information: (i) when required by law, court order, or other government or law enforcement authority or regulatory agency; or (ii) whenever we believe that disclosing such Information is necessary or advisable, for example, to protect the rights, property, or safety of Potluck or others.
Payment Processing and Stripe
Certain Registered Users ("Hosts") may elect to collect payments from event attendees ("Guests") through the Website. All payment processing is handled by Stripe, Inc. ("Stripe"), a third-party payment processor. Potluck does not collect, process, transmit, or store payment card numbers, bank account numbers, or other sensitive financial data. Such data is submitted directly to Stripe and is governed by Stripe's privacy policy, available at https://stripe.com/privacy.
1. Payment Data Collected. When a Guest makes a payment through the Website, the following information is collected in connection with that transaction: (a) the Guest's name and email address, as registered with Potluck or entered at the time of payment; (b) the payment amount and date; (c) a transaction reference identifier issued by Stripe; and (d) the last four digits of the card used, as returned by Stripe for receipt and record-keeping purposes. Potluck does not collect or store full card numbers, CVV codes, or expiration dates. When a Host connects a Stripe account, Potluck receives and stores a Stripe Connect account identifier and associated payout details (such as the last four digits of the connected bank account) in order to display payout status within the Website.
2. How Transaction Data Is Used. Potluck uses payment transaction data solely to: (a) display payment status and history to the Host and Guest within the Website; (b) generate and deliver payment receipts to Guests via email; (c) provide Hosts with a summary of collected payments and payout status; (d) process refunds at the direction of the Host; and (e) comply with applicable legal and financial recordkeeping obligations. Potluck does not use payment transaction data for advertising, marketing, or sale to third parties.
3. Sharing Payment Data with Stripe. To facilitate payment processing, Potluck shares certain Personal Information with Stripe, including a user's name and email address, as necessary to initiate a transaction or establish a Stripe Connect account. This sharing is solely for the purpose of enabling the payment feature and is governed by Stripe's privacy policy. Potluck does not sell payment data to Stripe or any other third party. By using the payment feature, you authorize Potluck to share such information with Stripe as described herein.
4. Data Retention for Payment Records. Potluck retains payment transaction records (including transaction identifiers, amounts, dates, and associated user identifiers) for a minimum of seven (7) years following the date of the transaction, or such longer period as may be required by applicable law. This retention period exists to support financial recordkeeping, dispute resolution, and legal compliance obligations. Requests to delete payment records may be limited to the extent that retention is required by law. For all other Personal Information, please refer to the "Accessing and Modifying Information and Communication Preferences" section above.
How We Protect Your Information
We take commercially reasonable steps to protect the Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases or the databases of the third parties with which we may share such Information, nor can we guarantee that the Information you supply will not be intercepted while being transmitted over the Internet. In particular, e-mail sent to us may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail.
Important Notices to Non-U.S. Residents
The Website and its servers are operated in the United States and elsewhere. Please be aware that your Information, including your Personal Information, may be transferred to, processed, maintained, and used on computers, servers, and systems located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to use the Website, you hereby irrevocably and unconditionally consent to such transfer, processing, and use in the United States and elsewhere.

The Website may contain links to third-party websites. Potluck has no control over the privacy practices or the content of these websites. As such, we are not responsible for the content or the privacy policies of those third-party websites. You should check the applicable third-party privacy policy and terms of use when visiting any other websites.
Children
The Website is not directed to children under the age of 13. Potluck adheres to the Children's Online Privacy Protection Act ("COPPA") and will not knowingly collect Personal Information from any child under the age of 13. We ask that minors (under the age of 13) not submit any Personal Information to us. If you are under the age of 13, you may use the Website only with the consent of your parent or guardian.
If a child under the age of 13 has provided us with Personal Information, a parent or guardian of that child may contact us and request that such information be deleted from our records.

California Residents
Under California Civil Code Section 1798.83, California residents who have an established business relationship with Potluck may choose to opt out of our sharing your Personal Information with third parties for direct marketing purposes. This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy from time to time. Any such changes will be posted on the Website. By accessing the Website after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes. Please be aware that, to the extent permitted by applicable law, our use of the Information is governed by the Privacy Policy in effect at the time we collect the Information.
